Türkiye’de Yargı Kurumuna İlişkin Güven Algısını Etkileyen Faktörlerin Belirlenmesine Yönelik Bir Ölçek Geliştirilmesi

Abstract

Like the other state institutions, level of judicial trust is determinant on political trust (trust on whole state). Judiciary as a third power of state, increases the determination with its “arbitrator” role. Current debates in social trust level on judiciary are heated time to time in Turkey. However, none of these debates have academic background. They are limited to public opinion polling studies which are related to cyclical developments. Main aim of this project is to develop a reliable and valid scale for measuring support level of community towards judiciary through trust. A quantitative research method is prefered in this framework. For this purpose, first a literature review was made and after that the theoretical background affecting judicial trust is stated and these factors were transferred to an article pool. 38 articles found to be suitable are listed after examining an expert panel including 9 people. After the pilot study, the reliability and validity of the articles are examined by the help of a scale containing revised articles and it is applied to 2139 people in 12 cities with a form of 35 questions. The scale of “measurement of factors affecting the perception of judicial trust in Turkey” is comprised of articles under 5 themes, “political trust”, “judicial transparency and accountability”, “social trust”, “access to justice services” and “judicial awareness”.
