Bu tez, Yemen Cumhuriyeti'nde Ahvali-i şahsiyye kanununun bölümlerinden biri olan nikah akdi kanununun maddelerini araştırmayı, kanun maddelerinin Islam hukuku ve onun tatbiki kısımlarıyla (füru' ile)ne derece örtüştüğünü ve Islam mezheplerinden hangisinin bu kanunu en çok etkilediğini araştırmayı hedeflemiştir. Bu analiz yapılmadan önce, kanunlaştırılmasından itibaren Yemen Kanunu ve maddeleri, Kuzey ve Güney Yemen kanunları ile de karşılaştırılması yapılarak, bilimsel yöntemlerle incelenmiştir. Tezin vardığı sonuçlar kanun maddelerinden hiçbirinin Islam Hukuku ve onun ruhuyla ters düşmediği, Yemen'de kanun koyucu otoritenin belirli bir mezhebe bağlı kalmayıp, aksine mezheplerin ittifak ettiği görüşleri veya insanlara en kolay ve en uygun olduğunu düşündüğü mezhep görüşünü almayı tercih ettiğidir. Tezin ulaştığı neticelerden biri de birçok kanun maddesinin, özellikle de evlilikle ilgili hususları da içinde barındıran sosyal hayata ilişkin kanun maddelerinin yeniden gözden geçirilmesi gerektiğidir. Sosyal hayata ilişkin bu kanunlar Yemen toplumunun ürünü olup Yemen Kanunu tarafından iyileştirilmemiştir ve toplumdaki mevcut birçok sorunun çözüme kavuşmasını sağlayacak bir gözden geçirmeye ihtiyaç duymaktadır.
The purpose of this thesis is to study the articles of the Marriage Contract Law, which is one of the branches of the Personal Status Law in force in the Republic of Yemen, and the extent to which the articles of the law are in accordance with the principles of Islamic law and its branches, and the knowledge of any Islamic sects has had the greatest influence in the articles of this law. Yemeni law since the beginning of codification, through the laws of South and North Yemen and comparing them with the new Yemeni law based on the analytical approach in the evaluation and study of the articles of this law. This thesis found that all the articles of the law did not find any violation of Islamic law and its principles, and that the Yemeni legislator did not adhere to a particular doctrine, but was taking what is agreed upon between the doctrines, or take a particular doctrine according to what he considers the most appropriate and easier for people, The thesis also found that there are legal articles that need to be reviewed in the formulation and arrangement, especially in social matters that are related to marriage, which is occurring in the Yemeni society and has not been dealt with by law. It needs to be reexamined to address those issues that may solve many problems in Yemeni society regarding marriage.
