6331 sayılı iş sağlığı ve güvenliği kanununda belirli ihlaller için çeşitli idari yaptırımlar öngörülmüştür. Bu idari yaptırımlardan birisi de işin durdurulmasıdır. İşin durdurulmasına yönelik detaylar, 30.03.2013 tarih, 28603 sayılı Çalışma ve Sosyal Güvenlik Bakanlığından: İşyerlerinde İşin Durdurulmasına Dair Yönetmelik'te mevcuttur. Yönetmelikte, işin hangi durumlarda durdurulmasına karar verileceği açıklanmakla beraber bu konuya ilişkin uygulamaya yönelik düzenlemeler mevcuttur. Diğer ülkelerle karşılaştırıldığında, ülkemizin daha yüksek iş kazası oranlarına sahip olduğu görülmektedir. Soma faciasının ardından, iş sağlığı ve güvenliğinin etkin şekilde sağlanmasına yönelik kamuoyunda güvensizliğin arttığı giderek daha belirgin hale gelmiştir. Aynı yönde, Kamu Denetçiliği Kurumu tarafından sunulan Soma Özel Raporu'nda da İş Güvenliği Paketi'nin ortaya çıkmasında Soma faciası için getirilen eleştirilerin etkili olduğu ifade edilmiştir. Diğer taraftan, çalışmamızın konusunu oluşturan durdurulan işlerde izinsiz çalıştırma suçuna ilişkin Türkiye Büyük Millet Meclisi Komisyon Raporu'nda, çalışanların can güvenliğini tehlikeye atan işveren veya işveren vekillerinin caydırıcı şekilde cezalandırılmasının hedeflendiği ifade edilmiştir. İşin durdurulması kararına uymayarak izinsiz çalıştırma yaptırma şeklindeki fiilin yaptırımı 04.04.2015 tarihli 6645 sayılı Kanundan önce idari para cezasıydı. Fakat mevcut düzenlemede idari para cezası yerine hapis cezası öngörülmektedir. İş Sağlığı ve Güvenliği Kanunu'nun 25. maddesinin 8. fıkrasına göre, işyerinde durdurulan işlerde izinsiz çalıştırma yaptıran işveren veya işveren vekillerine, üç yıldan beş yıla kadar hapis cezası verilecektir. Durdurulan işlerde izinsiz çalıştırma yaptırma fiilinin yaptırımı 04.04.2015 tarihinden önce idari para cezası olduğu için fiil bir kabahat teşkil etmekte iken yaptırım olarak hapis cezasının öngörülmesiyle bu fiil artık bir suç teşkil etmektedir. Suça ilişkin genel bir çerçeve çizilmiş olsa da suç özelinde belirsizlik içeren birçok husus vardır. Çalışmamızda bu belirsizlikler açıklığa kavuşturulmaya çalışılacaktır.
In accordance with the stipulations set forth in Law No. 6331 on occupational health and safety, a range of administrative sanctions are in place for violations of the aforementioned legislation. One such administrative sanction is the suspension of work activities. Further details regarding the suspension of work can be found in the regulation on the suspension of work in workplaces, dated 30/03/2013 and numbered 28603, published by the Ministry of Labour and Social Security. The Regulation on the Suspension of Work in Workplaces The Regulation elucidates the circumstances under which a work stoppage will be ordered and provides practical regulations on this issue. In comparison to other countries, Turkey has a higher incidence of occupational accidents. In the wake of the Soma tragedy, it has become increasingly evident that there is a growing public perception of distrust in the effective provision of occupational health and safety. Similarly, the Soma Special Report submitted by the Ombudsman's Office indicated that the criticisms of the Soma disaster were instrumental in the development of the Occupational Safety Package. Conversely, the Grand National Assembly of Turkey Commission Report on the offence of unauthorised employment in suspended work, which is the subject of our study, states that the objective is to punish employers or employer representatives who endanger the safety of employees in a deterrent manner. Prior to the enactment of Law No. 6645 on 4 April 2015, the sanction for engaging in unauthorised employment in contravention of a work stoppage decision was an administrative fine. However, the current regulatory framework prescribes imprisonment as an alternative to the previously applicable administrative fine. In accordance with paragraph 8 of Article 25 of the Occupational Health and Safety Law, any employer or representative of an employer found to be engaging in unauthorised work in the workplace may be sentenced to a term of imprisonment ranging from three to five years. Prior to 4 April 2015, the sanction for the act of unauthorised employment in a stopped workplace was an administrative fine. However, the act now constitutes a crime with the provision of imprisonment as the sanction. Although a general framework has been established regarding the offence, there are numerous issues that remain unclear. This study aims to address these uncertainties.
