İslam hukukunda uyuşturucu madde suçları ve cezaları

Abstract

TÜRKÇE ÖZET Araştırmamızda İslam Hukukunda uyuşturucu maddelerin hükümlerini ortaya koymaya çalıştık. Giriş bölümünde konuya ışık tutması açısından, uyuşturucu maddelerin dünyada ve ülkemizde gelişimini ve fakihlerin uyuşturucuların nitelikleri hakkındaki görüşlerini aktardık. Konuyu, önce suç olarak ele alıp tanımlamasını ve şer' i nasslardaki mesnedini araştırma ya çalıştık. Daha sonra failin hangi şartlara haiz olması gerekir, suçun maddi ve ma'nevi unsurları nelerdir, kusur yeteneği, zorla bu maddelerin kullandırılması, bu maddelerle tedavi olma hükmünü ve suçun hangi vesilelerle ispat edileceğini anlattık. Konuyla ilgili açık bir nass olmamakla birlikte, bu maddelerin içkiye kıyaslanması ve İslam Hukukunun genel kaide ve prensiplerinden bu maddelere bakış açısını izah ettik. Cezayla ilgili bölümde, bu maddelere ceza verilmesinde gözetilen hedef, aklın korunmasının hikmetlerini ve bu cezanın ceza sistemi içerisindeki yerini anlatmaya çalıştık. Daha sonra cezayla ilgili İslam Hukukunun verdiği -fakihlerin görüş farklılıklarıyla birlikte- cezanın ne ve nasıl olduğu, uygulama şekli ve hakimin takdir yeteneği, suçlunun topluma kazandırılması için tedavi, ıslah ve te'dibi ve yollarını aktarmayı denedik. vıı

Title: The Crimes and punishments of Drugs in Islamic Law In this research, It is tried to be put forward the provisions and legal injunctions about of drug elements in Islamic Law. Aiming this goal, we have given historicil uprise of drugs in our country and in the world in the introduction of this work, to contribute to understanding of main subject. Firstly, the drugs are taken into account and defined as a crime, at the same time their prohibition proofs have been shown from main Islamic sources. Thereafter, the provisions that the guilty has to bear, subjective and objective requirements of the crime have been discussed. Meanwhile; "the ability of crime", "use of this elements under force", "opinions of muslim lawyers about use of these elements for treatment" and "the ways of proof for this crime" subjects have been studied in detail. As no direct proof on these matters are found in main sources, It is discussed under comparison with the alcoholic drinks from the point of wiev "how generel provisions of Islamic Law regard these elements". As regards the punishments; "the goals of punishing the criminals", "the wisdom of human mind protection" and "the place of this punishment in Islamic criminal system" subjects have been tried to be given. After these presentations, varios and different ideas of the well-known Islamic Lawyers on "the punishment" for use and trade of these elements are reported. Lastly, the judge's opinion and jurisdiction, the ways of treatment and rehabilitation of the addicts of drugs were the subject that concluded this work. vm
