Abstract

Bu araştırmanın konusu "Adam Çalıştıranın Sorumluluğu"dur. Adam çalıştıranın sorumluluğu, Türk Hukukunda Borçlar Kanunun 55. maddesinde yer almaktadır. Ayrıca bu madde Borçlar Hukukunun en önemli konularından birisidir. Bu çalışmada, ilk olarak sorumluluğa ilişkin esaslar ve hukuki sorumluluk çeşitleri üzerinde durulmuştur. Çalışmanın ikinci bölümü, sorumluluk hukukunun kısaca tarihçesi, sorumluluk hukukunun amacı ve sorumluluk hukukundaki gelişmelerle ilgilidir. Üçüncü bölümde, adam çalıştıranın sorumluluğu kavramı ve hukuki niteliği incelenmiştir. Ayrıca adam çalıştıranın sorumluluğu ve sorumluluğunun hukuki sonuçlan açıklanmıştır. Daha sonra bu bölümde adam çalıştıranın sorumluluğunun benzer kavramlardan ayrılması üzerinde durulmasıdır. Çalışmanın dördüncü bölümü adam çalıştıran sıfatıyla Devletin sorumluluğuyla ilgilidir. Bu bölümde, zararların tazmininde önemli problemler vurgulanmıştır. Burada, zararın ispatı, zararın denkleştirilmesi, tazminattan indirim sebepleri ve zaman aşımı ortaya konulmuştur. Bu çalışma, sonuç ile sona ermektedir.

The subject of this research is "The Responsibility of Employer". the responsibility of employer in Turkish Legal System was found in Turkish obligation Code (BK. 55). İn addition to, this article (md.55) is The most important subjects law of obligation. İn this study, firstly, it was pointed out the principles concerning responsibility am kinds of legal responsibility. Also, here, it was explained the kinds of responsibility law. The first part of study is related to short history of responsibility law am evolutions in Turkish Responsibility Law, aims of responsibility law am evolutionns in Turkish responsibility law. İn the second part, responsibility of employer was investigated as a consept am legal quality. İn addition to, the conditions of "the responsibility of employer" am legal result of the responsibility was explained. After wards, in this part, the responsibility of employer was seperated from smilar concepts. The fourt part of study is connected with rsponsibility of state in aspect "employer". İn this part, it was pointed out important problems in indemnifacition the damages. Here, it was disclosed the proof of damage, eguivalence of damage, causes concerning reduction from indemnity and prescription. This study was finished with a "conclusion".
