5393 Sayılı Belediye Kanunu'nda idari vesayet denetimi

Abstract

Yerel yönetim kuruluslarının kullandıgı yetkiler egemenligi kullanan devlet tarafındankendilerine verilmis olan yetkilerdir. Yetkiyi veren devlet olunca bu yetkinin nasılkullanıldıgını denetleme görevi de devlete düsmektedir. Devlet bu yetkisini idari vesayetdenetimi ile kullanmaktadır.Devletin bu denetim yetkisini kullanmasındaki amaç, verilen yetkilerin kötüyekullanılmaması, hizmetlerin tarafsız bir sekilde tüm mahalli halka ulastırılması ve enönemlisi de yönetimde birligin saglanmasıdır. Nitekim idari vesayet denetiminin katı birsekilde kullanılması onu amacından saptırabilmektedir. Bu durum yerel yönetimlerin kendiorganlarınca yürütülebilir kararlar almalarını engelleyebilmektedir.Genelde yerel yönetimlerin özelde de belediyelerin bu ve benzer sorunlardankurtulabilmeleri için kamu yönetiminde yeniden yapılanma çalısmaları çerçevesinde birtakım düzenlemeler yapılmıstır. Bu düzenlemelerin belediyeler için olan yansıması 5393sayılı Belediye Kanunu olmustur. Bu kanunla birlikte belediyeler Özerklik Sartı'ndabahsedilen nitelige kavusturulmaya çalısılmıstır. Nitekim kanunda, özellikle belediyeleringeçmis dönemde içinde bulundukları agır vesayet denetiminden, bir takım eksikliklerolmasına karsın kurtuldukları gözlenmektedir. Belediyelerin söz konusu idari vesayetdenetiminden nispeten kurtulmus olmaları özerk yerel yönetim anlayısında önemli adımlaratıldıgına isaret etmektedir.

The authorities used by local governments are endowed by the state. Since the stateendows that authory, then the state supervise that authority. The state uses thisauthority through administrative supervision.The propose of this supervision is to prevent the abuse of the use of authority andfacilitate the impartial use of services by the local people, and most importantly,create unity in administration. Accordingly, strong use of supervision may deviate itfrom its purpose. This may prevent the local administrations to make decisionsupheld by their own organs.A number of new regulations aim to resolve such problems faced by localadministrations in general and municipalities in particular. These regulations havereflected to municipal Code Number 5393. This code aims to render municipalitiesto achieve the condition mentioned in the Charter of Local Autonomy. Thus,municipalities are now free, if not totally of strong supervision they faced in thepast. The fact that municipalities are relieved from that administrative supervisionindicates to the new steps taken toward the conception autonomous localadministration.
