Muhyiddin El - Kafiyeci ve Vecizü’n Nizam Fi İzhahi Medariki’l Ahkam adlı eseri

Abstract

XIV.yüzyılın sonu ile XV.yüzyılda yaşamış olan Muhyiddîn el-Kâfiyeci Arap dili ve edebiyatıbaşta olmak üzere; tefsir, hadis, kelam, fıkıh vb. bir çok ilim dalında eser vermiş ve sayısızöğrenci yetiştirmiştir.İslam hukuku alanında verdiği eserlerde, daha çok bugün dahi güncelliğini koruyanmezheplerin mahiyeti, içtihat, taklit, hükmün araştırılması ve mukallidin durumu gibi konularadeğinmiştir. İlmi çalışmalara taklidin damgasını vurduğu bir dönemde Kâfiyeci, içtihadın herdönemde gerekli olduğunu söylemekte ve alimleri içtihat yapmaya teşvik etmektedir. İşte buözelliği, bizi kendisine ait bir eserin tahlil ve tahkikini yapmaya sevk etmiştirÇalışmamıza konu olan ?Vecîzü'n-Nizâm? adlı eserde, halefin ve selefin içtihat metotları ayrıayrı açıklanmıştır. Yeni sorunlar ortaya çıktığında, yeni içtihatların yapılabileceği üzerindedurulmuştur. Kâfiyeci içtihat yapabilmeyi halefin ve selefin yöntemini bilmeye bağlamış vebizzat kendisi yeni içtihatların nasıl yapılabileceğini örneklerle açıklamıştır.Müellifin hayatının araştırılması sırasında biyografi eserlerinden istifade edilmiştir. Risâleniniki nüshası tespit edilmiştir. Süleymaniye Ktp. Ayasofya bölümü ve Leipzig Üniversite Ktp.ndebulunan iki nüsha karşılaştırılarak incelenme imkanı bulunmuştur. Nüshaların orjinalliklerinedokunulmadan, nüsha farklılıkları belirtilip varak numaraları kaydedilmiştir. Muhyiddin el-Kâfiyaci lived between at the end of XIVth centery and in the XVthcenteruy, he wrote several Works principally about Arabic Language and Arabicliterature; interpretation, religious tradition (prophet?s saying) theology, canonical etc.And he trained unnumbered student.In the Works he wrote about Islamic Law, mostly they also maintain their currents, onthe esence of the sects interpretation, imitation, research of the judgement and he wroteon the subjects of the situations of the imitator. In the period where the imitationstamped its stamp on the scientific sciences, Kâfiyaci said that interpretation isnecessary for every period and he encouraged the scholars to make interpretation. Likethat his this characteristic encouraged us to examine a work belonging to him.In the work named ?Vecizü?n-Nizam? which is subject on our study. The methods ofinterpretation of the halaf and salaf are separately explained. When new problemshappened, he insisted that new interpretation can be made. Kâfiyaci explained that tobe able to make interpretation this depends on the halaf and salaf must know the way ofdoing it and he personally explained with examples that how the new interpretationscan be done.During the research of writer life we have profited from biographical Works. Twocopies of the brochures werw determined. In Süleymaniye library Ayasofya Divisionand Leipzig University library two copies by comparing the possibility of examinationwas found. Without changing the originalty of the copies, the differences of the copywere determined and the numbers of the sheet of paper were registered.
