Karaçelebizâde Abdülaziz Fetâvâsı Bağlamında Aile Hukuku = Family Law in the Context of Karachelebızaadeh Abd al-Azeez Efendi's Fatâwâ

Abstract

Bu tez; 17. yüzyıl Osmanlı Devleti'nin hüküm sürdüğü coğrafyada yaşamış, farklı dönemlerde müderrislik, kâdılık, kazaskerlik ve şeyhülislâmlık vazifelerinde bulunmuş; devrinin âlim, müftî ve müverrihi, Karaçelebizâde Abdülaziz Efendi'nin fetvâ mecmû'ası türündeki eseri olan (Fetâvâ-yı Karaçelebizâde)'nin nikâh-talâk bölümlerinin transkripsiyon ve îzâhatları başta olmak üzere müellifin hayatını, fıkhî/tabiî şahsiyetini, eserlerini, İslâm fetvâ müessesini, Osmanlı hukuk nizâmını, İslâm aile hukuku konularını kapsamaktadır. İlaveten, tarihin seyri içerisinde önemli bir mevkiyi tutan şeyhülislâm fetâvâlarının içinde çalışılmayı bekleyen (Fetâvâ-yı Karaçelebizâde) isimli eseri ana hatlarıyla tanıtıp günümüz araştırmacılarının hizmetine sunmayı ve özellikle bu eser içerisindeki aile hukuku konularını ihtivâ eden nikâh-talâk mevzularını tetkik etmeyi amaçladık. Çünkü aile, İslâm tarihi ve kültürü içerisinde yer alan en önemli yapı taşlarından biridir. Biz de Türk-İslâm medeniyetinin önde gelen mümessillerinden olan Osmanlı Devleti'nin mühim bir ferdi Karaçelebizâde'nin şeyhülislâm olduğu dönemlerdeki fetvâlarına yansıyan aile yapısını ve Osmanlı hukuk nizâmını inceleyerek nice faydalı sonuçlara ulaşmak, literatürümüze önemli bir değer kazandırmak istiyoruz. Bu bilgi ve neticelere ulaşırken ikinci bir nüshaya ulaşamadığımız için başta fetvâ eserinin orijinal el yazması olan nüshadan faydalanma yolu izlenmiştir. Bunun yanında kıymetli, tarihte yerini sağlam bir şekilde alan fıkıh kitaplarıyla birlikte muteber tarih kitapları ve konumuzla irtibatlı gördüğümüz; kitap, tez, makale, akademik dergi yazısı ve ansiklopedi maddesi gibi her türlü te'lifâttan da faydalanılmıştır. Çalışmamızda takip ettiğimiz bu usûle ek olarak, nikâh-talâk mevzularının transkripsiyonunda elde ettiğimiz malumatlarla birlikte eserin; rakamsal tahlilleri, muhtevasından çıkardığımız bilgiler de çalışmamıza ışık tutmuştur. Bu tez çalışması, müellifin hayatî bilgilerini devrin tarihî bağlamıyla eseri ve eserin mevzumuzla alakalı bölümlerini ise İslâm aile hukuku bağlamında değerlendirmek suretiyle yürütülmüştür.

This thesis covers the family law sections of (Fetāwā-yi Karachelebızaadeh) the work of Karachelebızaadeh Abd al-Azeez Efendi, a scholar, mufti, and historian of his time who lived in the geography where the Ottoman Empire ruled in the 17th century and served as a mudarris, qadi, qadi 'asker, and shaykh al-islam of the state in different times. This book is in the genre of works in which fatwas are collected. It also includes the transcription of the chapters of 'Fetâwâ-yi Karaçelebizâde' on marriage and divorce and explanations of these issues. In addition, the author's life, academic and natural personality, his works, the institution of Islamic fatwa, the Ottoman legal order and Islamic family law are also discussed. Our aim is to introduce the work titled 'Fetâvâ-yı Karachelebızaadeh', which is waiting to be researched among the fatwas of Sheikhülislam, which has a very valuable place in history.In particular, we wanted to examine the marriage and divorce issues of this work, which include family law issues in detail and present them to today's researchers. Because the family issue is a core of Islamic history and culture. We want to reach many useful conclusions and add important values to our literature by examining the family structure and the Ottoman legal system described in the fatwas of Karachelebızaadeh, an important individual of the Ottoman Empire, one of the leading states of Turkish and Islamic civilisation, during the periods when he was shaykh al-islam. While researching this information and conclusions, the original manuscript of the fatwa was used. The reason of this is that a second copy of the manuscript could not be found. In addition to this method, books of fiqh, which have a great value in history, respected history books and all kinds of works such as books, theses, articles, academic journals and encyclopaedia articles that we consider relevant to our subject were also used. In addition to this method we followed in our study, the numerical analysis of the book and the information we obtained from its content, together with the information we obtained from the transcription of marriage and divorce issues, also enlightened our study. This thesis has been conducted by evaluating the author's bibliographical information in the historical context of his time and the relevant parts of the work in the context of Islamic family law.
