Mülki idare amirleri ve yerel yönetimler arasındaki ilişkiler (Türkiye-Fransa örneği)

Abstract

ÖZET Bu çalışmanın amacı, Türkiye'de ve Fransa'da merkezî yönetimin il ve ilçelerdeki temsilcileri olan mülkî idare amirleriyle, il, bölge, belediye (komün) ve köyler gibi birimlerden oluşan yerel yönetimler arasındaki ilişkileri incelemektir. Çalışma giriş, sonuç ve üç ana bölümden oluşmaktadır. Birinci bölümde Türkiye ve Fransa'da yönetim geleneği ve yönetimi etkileyen faktörler ele alınmış, bu çerçevede söz konusu ülkelerde merkezî ve yerel yönetimlerin tarihi gelişimlerine değindikten sonra, her iki ülkenin de yönetimlerinin temel unsuru olan üniter devlet ve merkeziyetçilik konulan incelenmiştir. Bu bölümde ayrıca, Türkiye'nin hem imzalayıp, hem de onayladığı, Fransa'nın ise imzalamakla birlikte henüz onaylamadığı, Avrupa Yerel Yönetimler Özerklik Şartı üzerinde durulmuş ve daha sonra da Yerellik İlkesi (Subsidiyarite) konusunda bilgi verilmiştir. İkinci bölümde, Türkiye'de mülki idare amirleri olan Vali ve Kaymakamlarla, il özel idareleri, belediyeler ve köylerden oluşan yerel yönetim ilişkileri incelenmiş, mülki amirlerin kırsal kesime yönelik kalkınma çabalan ile kaynak bulma gayretleri çerçevesinde yerel yönetim birlikleri gözden geçirilmiştir. Üçüncü bölümde ise, Fransa'da, özellikle vali ve daha sonra da kaymakamlann, il özel yönetimi, bölge yerel yönetimleri ve belediyelerle olan ilişkileri üzerinde durulmuş ve ilişkiler açısından çok büyük önem arzeden 1982 Reformu irdelenmiştir. Bu reformla birlikte, Fransız merkezi ve yerel yönetimler sisteminde gerçekleştirilmiş olan köklü değişiklikler ele alınmıştır. Çalışmada, mevcut durum ve sorunlar karşılaştırmalı olarak incelenmeye çalışılmış, uygulamada karşılaşılan sorunlar, deneyimler ve birikimler ile yasal metinler gözönüne alınarak konu ortaya konmaya gayret gösterilmiştir. Vanlan sonuç, Klasik Dönem Osmanlı yönetim yapışım bir kenara bırakacak olursak, Tanzimat'la birlikte merkezî ve yerel yönetirnlerimizin, Batılılaşmanın da bir unsuru olarak etkilenmiş olduğu Fransız yönetim sistemindeki gelişim ve özellikle 1982 Reformundan sonraki değişimlerin yönünü göz önüne alarak birtakım düzeltimlere gitmemizin zorunluluğunu ortaya koymaktadır.

The intent of this study is to analyze the relations between the province and district administrative representatives which are a part of the central governance system, like the governors or civil officials, with that of the local administrators, like mayors or town councils, of the provincial, regional, municipal, or villages in France and Turkey, The name of this thesis is "A Comparative Analysis of the Intra-administrative Relations Between the Central Government Administrators and the Local Officials: The Cases of France and Turkey." The study is comprised of an Introduction, Three Main Sections and a Conclusion. In the First Section the historical administrative tradition is surveyed, and facts that are impacting on governance, in general, are examined. In this framework, for both countries the foundational status of the 'unitary-state1 within a central governance system has been analyzed. Additionally, in this section, the Autonomy of the Local Governing System in Europe has been examined in detail and the question of why the government of France has been putting this off while the Turkish Government already has it signed and ratified it. After this the subsidiarity principle is examined. In the Second Section, the Turkish Provincial and District Governors' relations with the local municipalities, the local private interest groups, and the rural area representatives have been analyzed. Also in the process, the Governors' efforts in locating funding for local investments and local municipal projects have been explained in the same framework. The Third Section deals with the French system more in dept. The provincial and district governors' relations with that of local and municipal administrations are studied from the perspective of the 1982 Reforms. The study further analyzed the Reform's impact on the French central and local administrations. In the study, the present situation in both countries and their corresponding problems were ascertained. Since the author of this dissertation has the background of a centrally administrated system by profession, the problems encountered during their application phase, in addition to legal documents, personal experiences and practical know how were utilized. In conclusion, putting a side the earlier Classical Ottoman period, it is found that the Tanzimat period in Ottoman Turkey is assumed as the beginning of the Westernization process. The acquired French governance system was considered as the impetus of this Westernization movement; and thus, the central and local administrative system was heavily influenced by the French system. In the more recent times, however, especially with the changes since the 1982 reforms, it has become apparent that we need to proceed with reforms of our own.
