Devredilemeyen ve vazgeçilemeyen temel haklardan olan yaşama hakkının sağlanması Devletin Anayasal ve yasal görevleri arasında bulunmaktadır. Buna göre, ilgilinin hastalanması halinde tedavisinde kullanılması gereken ilaca, en kısa sürede, makul fiyata, en az bürokratik işlemle ulaşmasının temini zorunludur. Kişilerin tedavilerinde kullanılması zorunlu olan ilaçlar ülke piyasasında henüz ruhsatlandırılmamış olabilir. Diğer bir durum ise, ruhsatlandırılmış olan ilaç Ülke piyasasında bulunmayabilir. Ancak bu ilaçların da hastaya ulaştırılması belirtildiği gibi Devletin Anayasal ve yasal görevidir. İlaca ayrılan sınırlı bütçe, buna karşın her geçen gün artan ilaç kullanımı, konunun denetiminin zorluğu gibi pek çok neden hastanın ilaca zamanında ve yeteri kadar ulaşmasını zorlaştırabilmektedir. Bunun önüne geçmek amacıyla ilaçların, üretimi, satışı, ithali, ruhsatlandırılması, piyasaya arzı veya verilen ruhsat ve izinlerin iptali konularında yetkili ve görevli olan Sağlık Bakanlığı tarafından Yurt Dışından İlaç Temini ve Kullanımı Kılavuzu yayınlanmıştır.

To overcome this problem, the Ministry of Health, which is authorized and responsible for the production, sale, importation, licensing, supplying to the market and cancellation of licenses and permits issued, has published a Guide to Supply and Use of Drugs from Abroad.
