Hizmete Girişte Şartları Taşımayan Memurun Durumunun Sonradan Öğrenilmesinin Memuriyet Statüsüne Etkileri ve Sonuçları

Abstract

Kamu görevine girme hakkı, anayasal hüküm olarak karşımıza çıkmaktadır. Yasal şartları taşıyan herkes başka bir ayrım gözetilmeksizin memuriyete girme hakkına sahiptir. Bununla beraber kamu hizmetine girişte şartları taşımayan bir memurun durumunun sonradan öğrenilmesi hukuki bir problem oluşturmaktadır. Bu problemi ortadan kaldırmak adına atanma işleminin geri alınmasının gündeme gelmesi ve memuriyette kazanılmış hakların değerlendirilmesi, konuyu daha karmaşık bir hale getirmektedir. Bu çalışmada hizmete giriş şartlarını taşımayan memurun durumunun sonradan öğrenilmesinin onun statüsüne etkileri ve sonuçları incelenecektir.

The right for coming into public service appears as a constitutional provision. Everyone who meets the legal conditions has the right to be commissioned without any discrimination. However, coming to the realization on the status of a civil servant who does not meet the conditions for coming into public service creates a legal problem. Considering withdrawal of assignment and evaluating the vested interests on civil servants for solving the problem is making the issue more complicated. In this study the effects and the results of coming to the realization on the status of a civil servant who does not meet the conditions to be assigned in public service are analyzed.
